YOUR REVIEW HAS A PRIZE Terms and conditions for the “Your Review Wins a Prize” campaign organized by Líbere Hospitality, S.L.
ORGANIZING COMPANY
Líbere Hospitality, S.L. (hereinafter, the “Organizer”) with Tax ID B 95953683, and registered office at C/Gran Vía nº2, 8ºD, 48001 Bilbao, Bizkaia, organizes the “Your Review Wins a Prize” raffle (hereinafter, the “Raffle”) during the indicated dates, under the conditions outlined in these terms.
1. PROMOTION PERIOD
The period for participating in the raffle is from October 22, 2024, to November 30, 2024. Any entries submitted after this period will not be accepted.
2. RAFFLE PARTICIPATION
2.1. Users who complete the post-stay survey after staying at one of the Líbere-managed properties and rate their stay with a score of 8 or higher will be eligible to participate in the raffle.
2.2. To participate in the raffle: ● The post-stay survey must have been completed with a rating of 8 or higher, or the participant must have received an email to rate the stay during the stay. ● Participants must follow the instructions provided in the last page of the post-stay survey thank-you email, which includes: (i) leaving a positive review on Google or Tripadvisor about their stay, and (ii) completing the participation form included on the last page of the survey. ● Participants must be 18 years or older.
2.3. Each participant can only win one prize. 2.4. Legal entities, individuals employed by or professionally connected with the Organizer, and those directly or indirectly involved in organizing the raffle, including employees and/or collaborators of the Organizer or third-party companies, as well as their first-degree relatives by blood or marriage, cannot participate in the raffle. 2.5. Participation in the raffle constitutes full acceptance of these terms without reservation. Non-compliance with any part of these terms will result in immediate disqualification of the participant.
2.6. These terms are available to participants at: https://www.staylibere.com/es/bases-sorteo. This link to the raffle terms is included in the thank-you email sent to the guest after completing the post-stay survey.
3. PRIZE
The prize consists of a €180 voucher, which will be transferred to the winner’s bank account under the following conditions:
The voucher is only applicable to bookings made on https://www.staylibere.com/es, in any Líbere property, for room-only reservations and only under the “Non-Refundable Rate” option. It covers the cost of one night’s accommodation only and does not include half-board, full-board, or any other services beyond the one-night stay. The reservation must be made by June 30, 2025, excluding national and/or local holidays and high season months: June, July, and August. Once the Organizer contacts the winner via email to inform them that they have won the raffle, the winner must provide the date and property for their reservation and wait for written confirmation from the Organizer. After receiving confirmation, the winner must make the reservation via the website/phone under the “Non-Refundable Rate” and pay the full reservation amount. Once the reservation is finalized as indicated, the winner must send proof of the reservation to marketing@liberehospitality.com, along with their bank details. Within 30 calendar days from receiving this email, the winner will receive the €180 prize amount in the specified bank account.
The prize can be used until June 30, 2025, excluding national and/or local holidays, as well as high season months: June, July, and August.
If national or regional authorities impose restrictions on movement within the country and the winner is unable to use the prize during the specified dates, an alternative date will be agreed upon between the winner and the Organizer.
The Organizer is not responsible for any issues that may arise with the winner’s or their companion’s travel arrangements to claim their prize.
The prize does not cover travel and/or transportation expenses or any additional costs during the stay.
The Organizer reserves the right to substitute the prize with another of similar characteristics, of equal or greater value. The prize is personal and non-transferable and cannot be exchanged for cash.
4. RAFFLE DRAW
4.1. Raffle draw date: December 3, 2024, at 12:30 pm, at the Organizer’s headquarters.
4.2. Raffle mechanics: ● All participants who meet the participation conditions will be entered into an Excel file and assigned a participation number. A random draw will select 1 winner and 2 alternates. ● The winner’s and alternates’ names will be published at https://www.staylibere.com/es/bases-sorteo. This link will be available in the thank-you email received by the guest after completing the post-stay survey and will be active for 72 hours after the raffle draw.
4.3. Communication with the winner: The winner will be notified at the same email address to which the post-stay survey was sent. The notification will be sent on December 4, 2024. The winner must explicitly accept the prize within 7 calendar days from receiving the notification, by sending a prize acceptance email to marketing@staylibere.com.
If the Organizer does not receive this prize acceptance email, or the required tax certification within the indicated timeframe, it will be understood that the winner forfeits the prize, and it will be awarded to the next alternate.
If no contact can be made with the winner or alternates within the set timeframe, the prize may be declared void and will remain with the Organizer.
The winner may decline the prize but cannot exchange it for another or its cash equivalent.
5. RESERVATIONS AND LIMITATIONS
5.1. The Organizer is not responsible for any errors in the data provided by participants that may prevent identification, communication of the prize, or prize delivery. 5.2. The prize is personal and non-transferable. 5.3. The Organizer reserves the right to make changes to ensure the success of the raffle when justified or due to force majeure. 5.4. The Organizer reserves the right to modify or cancel the raffle’s terms due to external circumstances beyond its control. 5.5. The Organizer reserves the right to exclude participants who fail to meet any condition outlined in these terms. Exclusion results in the forfeiture of all rights as a participant.
6. IMAGE RIGHTS
6.1. By participating, the winner authorizes the Organizer to reproduce, use, and disseminate their name, surname, address, promotion-related information, and image, if applicable, for any advertising or promotional activities related to this raffle and/or its Organizer, through any media (including, but not limited to, internet), without any entitlement to compensation beyond the delivery of the prize.
6.2. Publication of the winner’s name does not guarantee the awarding of the prize if the participant does not meet the other conditions outlined in these terms, and the prize will be forfeited despite any publication.
7. PERSONAL DATA PROTECTION
Data Controller: Líbere Hospitality S.L., NIF B 95953683, registered office at C/Gran Vía nº2, 8ºD, 48001 Bilbao, Bizkaia. Purpose and legal basis: to manage participation in the raffle and, if applicable, deliver the prize. Data processed: data provided by participants during raffle registration and any additional data requested for the proper development of the aforementioned purposes. Recipients: No data will be communicated to third parties, except where legally required. International data transfers: The winner’s data may be published on the Organizer’s websites or social networks, potentially leading to international data transfers to countries with data protection laws that do not meet European standards. By participating in the raffle, the participant consents to such transfers, without prejudice to the Organizer’s implementation of additional measures to ensure data security. Data retention period: once the raffle is concluded, no further processing of your data will occur.
8. TAXES
8.1. The prize awarded in this raffle is subject to applicable tax regulations.
8.2. Any withholdings or payments on account of personal income tax or corporate tax that the Organizer is required to make in relation to the prize will be the responsibility of the Organizer. The winner must provide all necessary tax details for the Organizer to fulfill its legal obligations.
8.3. The Organizer will provide the winner with any necessary tax certificates related to withholdings or payments on account made.
8.4. The winner is responsible for meeting any tax or accounting obligations resulting from receiving the prize for their personal tax purposes.
8.5. The Organizer reserves the right to declare the prize void if the winner fails to provide the necessary information to fulfill its legal obligations, particularly those related to taxes.
9. APPLICABLE LAW AND JURISDICTION
These terms are subject to Spanish law. The Organizer and participants submit to the courts of Bilbao, expressly waiving any other jurisdiction, for any disputes arising from the application or interpretation of these terms.
