Terms and Conditions of the campaign “Your Review Has a Prize” organized by Líbere Hospitality, S.L.
ORGANIZER
Líbere Hospitality, S.L. (hereinafter, the “Organizer”) with VAT number B 95953683, and registered address at C/Gran Vía nº2, 8ºD, 48001 Bilbao, Bizkaia, organizes the “Your Review Has a Prize” draw (hereinafter, the “Draw”), according to the conditions stated in these terms.
1. PROMOTION DURATION
The period during which participants can take part in the draw will be from April 18th, 2024, to May 31th, 2024. No participation requests will be accepted outside of this period.
2. PARTICIPATION IN THE DRAW
2.1. Users who complete the post-stay survey after staying at any of the establishments managed by Líbere and rate their stay with a score of 7 or higher will be eligible to participate in the draw.
2.2. To participate in the Draw:
● Participants must have completed the post-stay survey with a rating of 7 or higher.
● They must comply with the requirements stated on the last page of the post-stay survey thank-you email sent to the guest; this includes leaving a positive review on Google related to their stay and (ii) completing the participation form included on the last page of the survey.
● Participants must be 18 years or older.
2.3. Each participant can only qualify for one prize.
2.4. Legal entities, as well as individuals professionally or laborally linked to the Organizer, or those directly or indirectly involved in the organization of the Draw, including employees and/or collaborators of the Organizer or third-party companies, and first-degree relatives of any of the mentioned parties, are not eligible to participate in the Draw.
2.5. Participation in the Draw implies the explicit and unreserved acceptance of these terms. Failure to comply with any of the conditions will result in immediate disqualification of the participant.

3. PRIZE
The prize consists of a €120.00 voucher, which will be credited to the winner’s bank account in the manner and subject to the prerequisites set forth below:
The voucher is applicable only to reservations made at https://www.staylibere.com/en, at any Líbere establishment, for accommodation only, and exclusively under the “Non-Refundable Rate” mode. The prize covers one night’s stay only. It does not include half-board, full-board, or any other service beyond one night’s stay.
Reservations can be made until November 30, 2024 (inclusive), excluding national and/or local holidays, as well as the high season months of June, July, and August.
Once the Organizer contacts the winner via email to inform them of their win, the winner must provide the date and establishment for the reservation and wait for written confirmation from the Organizer. Upon receiving confirmation, the winner must make the reservation online/phone, under the “Non-Refundable Rate” mode, and pay the full amount for the reservation.
Once the reservation is formalized as indicated, the winner must send the proof of the reservation to the email marketing@liberehospitality.com, indicating their bank details.
Within a maximum period of 30 calendar days from the receipt of the email, the winner will receive the €120.00 prize amount in the indicated bank account.
The prize can be enjoyed until November 30, 2024, excluding national and/or local holidays, as well as the high season months of June, July, and August.
If state or regional authorities impose measures restricting people’s mobility within the national territory, and the winner cannot enjoy the prize during these dates, a mutually agreed upon alternative date will be arranged between the winner and the Organizer.
The Organizer is exempt from any responsibility for incidents that may occur during the winner and their companion’s travel or transportation to enjoy the prize.
The prize does not include travel and/or transportation expenses, or any additional expenses during the stay.
The Organizer reserves the right to substitute the prize for another of similar characteristics, of equal or greater value than stated in these terms. The prize is personal and non-transferable and cannot be exchanged for cash.
4. DRAW CELEBRATION
4.1. Draw Date: June 3rd, at 16:30 PM, at the Organizer’s central offices.
4.2. Draw Mechanism:
● All participants who meet the participation conditions will be included in an excel sheet and assigned a participation number. Through a random draw, 1 winner and 2 substitutes will be selected.
● The names of the winner and substitutes will be published at https://www.staylibere.com/en/draw-terms-and-conditions. This link will be accessible in the thank-you email received by the guest after completing the post-stay survey. This link will be active for 72 hours after the Draw’s celebration.
4.3. Communication to the Winners: The winner will be informed at the same email address to which the post-stay survey was sent. This communication will take place on June 3rd, 2024. After this communication, the winner must expressly accept the prize within 7 calendar days of receiving it by sending an acceptance email to: marketing@staylibere.com
If the Organizer does not receive this express acceptance email of the prize, and, if applicable, the corresponding tax certification duly signed within the indicated timeframes, it will be understood that the winner renounces the prize, and it will be awarded to the appropriate substitute.
If contact cannot be made with the winner or substitutes within the established period, the prize may be declared vacant and will be handled by the Organizer.
The winner may renounce the prize, but under no circumstances can it be exchanged for another or for its cash value.
5. RESERVATIONS AND LIMITATIONS
5.1. The Organizer is exempt from any responsibility for errors in the data provided by the participants that prevent their identification or subsequent communication of the prize or its delivery.
5.2. The awarding of the prize is personal and non-transferable.
5.3. The Organizer reserves the right to make changes that contribute to the successful completion of the Draw in the event of just cause or reasons of force majeure that prevent it from being carried out as described in these terms.
5.4. The Organizer reserves the right to modify or cancel the Draw conditions due to circumstances beyond its control that make it advisable to do so.
5.5. The Organizer reserves the right to exclude participants who it deems are not complying with any condition included in these terms. Exclusion entails the loss of all rights derived from the participant’s status.
6. IMAGE RIGHTS
6.1. By simply participating, the winner authorizes the Organizer to reproduce, use, and disseminate their name, surnames, address, information provided by the participant regarding the promotion, and their image, if applicable, in any advertising and/or promotional activity related to this Draw and/or its Organizer, through any means (including, by way of example, but not limited to, exploitation through the Internet) without these activities conferring any right to remuneration or benefit, except for the prize won in accordance with these terms.
6.2. The publication of the winner’s name, as the awardee, does not grant any rights to the prize if the participant does not comply with the rest of the conditions set forth in these Terms, losing the right to the prize, despite any publication.
7. PERSONAL DATA PROTECTION
- Controller: Líbere Hospitality S.L., VAT number B 95953683, and registered address at C/Gran Vía nº2, 8ºD, 48001 Bilbao, Bizkaia.
- Purpose and Legitimacy: Process participation in the Draw and, if applicable, deliver the prize.
- Processed Data: Data provided by participants when registering for the Draw, as well as any additional data that may be requested for the proper development of the mentioned purposes.
- Recipients: For the fulfillment of the aforementioned purposes, data will not be disclosed to third parties, except legal obligation.
- International Transfers: The winner’s data may be published on various web pages or social networks of the Organizer. This publication may involve an international transfer to a country whose data protection regulations do not provide an equivalent level of protection to that of Europe. By participating in the Draw, the interested party accepts such transfer, without prejudice to the Organizer taking additional measures to ensure the security level of the provided data.
- Retention Period: Once the Draw is concluded, your data will not be processed.
- Rights: You may exercise your rights of access, rectification, erasure, portability, restriction, and objection, as well as the right not to be subject to automated individual decision-making, when applicable, by sending a letter to Líbere Hospitality, S.L., C/Gran Vía nº2, 8ºD, 48001 Bilbao, Bizkaia.
8. TAXES
8.1. The prize awarded in this Draw is subject to applicable tax regulations.
8.2. Withholding taxes or advance payments of Personal Income Tax or Corporate Income Tax that the Organizer may be required to apply as a result of awarding the prize will be borne by the Organizer. The winner will be required to provide all their tax information to the Organizer to comply with all formal obligations derived from this Draw. To this end, the Organizer will send a letter to the winner via email, so that the winner can provide all the necessary information.
8.3. The Organizer will make available to the winner, if applicable, and within the legally established timeframe, the certifications accrediting the withholdings or advance payments made.
8.4. The winner will be responsible for fulfilling the tax and accounting obligations associated with obtaining the prize for their personal taxation.
8.5. The Organizer may declare the prize void if the winner does not provide the necessary information for the Organizer to comply with its legal and especially tax obligations.
9. APPLICABLE LAW AND JURISDICTION
These Terms are subject to Spanish legislation. The Organizer and participants submit, with express waiver of any other jurisdiction that may apply, to the Courts and Tribunals of the city of Bilbao, for any dispute in the application or interpretation of these terms.”
